Liability Waiver & Indemnification
By submitting an entry, the entrant acknowledges that participation in the Chili Cook-Off involves inherent risks, including but not limited to potential exposure to food allergens and food-borne illness, hot equipment, and electrical service. The entrant represents and warrants that their chili was fully cooked in a sanitary manner using safe food-handling practices and is safe for ambient display and hot holding.
To the fullest extent permitted by law, the entrant voluntarily assumes all risks associated with participation and hereby releases, waives, and holds harmless Adamstown Community Days, AppleUmpkin organizers, their officers, directors, employees, volunteers, agents, sponsors, the Borough of Adamstown, and venue owners (collectively, the “Released Parties”) from any and all claims, liabilities, demands, damages, losses, costs, or expenses (including attorneys’ fees) arising out of or related to participation in the event, including without limitation personal injury, illness, property damage, or loss.
The entrant further agrees to indemnify, defend, and hold the Released Parties harmless from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees and costs) arising from: (a) the entrant’s participation; (b) the preparation, ingredients, transport, hot-holding, or service of the entrant’s chili; or (c) any breach of these rules or of the entrant’s representations and warranties.
